- Abstract
The article develops the historical backdrop behind the adoption of the Rule Enabling Act. Topics discussed include U.S. code provisions that establish judicial rulemaking authority for practice; ways in which states enact their own forms of government, and they are free to adopt a constitution that includes and protects a separation of powers; and protections employed by the several states in regulating their respective judicial branches.
