The article focuses on the concept of using financial exigency in the public sector labor law to unilaterally abrogate collective bargaining agreements to help balance the budget during times of shortfall in the U.S. Topics discussed include Headley v. City of Miami court case on same; policy implications of exigent circumstances; and analysis of fiscal problems and the declaration of exigent circumstances in Toledo.
