- Abstract
In this article the author discusses the uncertainty resulted from the U.S. Supreme Court case, Ricci v. DeStefano, regarding employment discrimination. It offers an overview of the purpose and development of Title VII and the modern approaches to claims. It discusses the weaknesses in the ruling of the Supreme Court and examines the post-employment discrimination decisions of the case and the conflicts facing courts and employers in interpreting the basis in evidence standard in the future.
