- Abstract
The article discusses the unanimous decision of the Ontario Court of Appeals ordering the court-appointed monitor of Indalex Ltd. to pay from the reserve fund amounts equal to the deficiencies in its two underfunded pension plans. It was found that Indalex, as administrator of the pension plans, breached its fiduciary duty. The decision overturned the dismissal of a Companies' Creditors Arrangement Act (CCAA) judge of the motions submitted by United Steelworkers and former Indalex executives.
