- Abstract
The article evaluates whether the adoption of solar access laws portrays a useful basis for laws and policies governing wind rights for wind turbine developers and landowners regarding wind turbine wakes construction, wake effects, and wind lease agreements. It informs that social factors and economic impacts play important roles in formulating policy and influencing courts' rationales for evaluating ownership rights to access natural resources. It concludes that best approach for governing wind associated rights is to evolve such rights standards from similar regulations applicable to solar power that are already used in Japan, Great Britain, and in the states of New Mexico and California.
