- Abstract
The issue of criminalizing migratory irregularity is one of the issues that brings major debates in the area of migration law. Brazil, after the advent of Law 13.445/2017 (Migration Law), chose to abolish crimigration. However, through regulatory acts and proposals for legislative changes, the Brazilian State has sought to go back on the humanist character achieved at the time by the Migration Law. Given this scenario, it is necessary to investigate the main administrative and legislative measures that are being used so that Brazil can again adopt the possibility of arrest due to migratory irregularity. Indeed, such measures will be analyzed based on International Human Rights Law, the Brazilian Constitution and the Migration Act itself. As a result, it is expected to contribute to the consolidation of the understanding that the return of crimigration is unconventional, unconstitutional and illegal.
