- Abstract
In the year 2022 there were three unconstitutionality appeals against several precepts of Law of Catalonia 11/2020, of September 18, on urgent measures regarding income containment in housing contracts and modification of certain Catalan laws and a question of unconstitutionality, against the art. 2.1 a) and b) of the Decree-law of the Generalitat of Catalonia 34/2020, of October 20, of urgent measures to support economic activity carried out in leased business premises. As a consequence, four judgments of the Constitutional Court were dictated in 2022, which reflect the position of the High Court in competential matters before the establishment of a system of containment of rental income —and of expenses assumed by the tenant— by the Catalan legislator. In the present study, the content of the aforementioned resolutions and their anchoring in the latest constitutional jurisprudence will be analyzed. Likewise, its posible repercussions will be examined, given the model designed by the state legislator in the Law for the right to housing.
