- Abstract
The article analyzes whether layoff policies that prioritize the selection of teachers based on performance, without providing notice and the opportunity for a hearing to challenge the basis of their termination, violates the U.S. Fourteenth Amendment due process guarantee. It mentions the Chicago Public Schools decisions on which teachers to retain during layoffs. It also mentions the Government's initiatives, such as Race to the Top, have hastened the adoption of policies.
