- Abstract
The article presents a comparison on the requirements and relative benefits of domestic asset protection trusts between the states of Utah and Wyoming. The asset protection trusts would help the clients keep their real property away from the future creditors. The requirements for an asset protection trust in Utah would include an enforceable spendthrift provision, the trust should be created on or after December 31, 2003, and the trust should be irrevocable. The requirements for an asset protection trust in Wyoming should include being irrevocable, governed by the law of the state, and subject to spendthrift provision.
