The article presents an essay on the models of tort. On the model of costs, tort law promotes efficiency by requiring agents to internalize the costs they impose on others. A good explanation of tort law is provided by the model of costs, thus, it is expected to have a legal regime oriented towards the capture of the benefits the authors confer. However, in some instances, reinstitution allows the recapture of positive externalities, which is a trifling part of the law as compare to tort.
