- Abstract
This article investigates the links between tardiness and the concept of default («la demeure»). First, the author proposes a classification of contractual deadlines. He then turns towards the legal significance of the debtor's lack of punctuality and the creditor's lack of protest. In the absence of a deadline of strict compliance, the mere lapse of time does not bar the debtor from eventually performing his obligations. Civil law is of the view that the creditor's failure to send a notice of default belies two realities: the creditor tacitly agrees to the postponement of the performance and the credi-tor suffers no prejudice from this belated performance.
