- Abstract
The article discusess Kentucky Supreme Court case Argotte v. Harrington. Plaintiff brought this medical malpractice claim alleging that Defendant failed to obtain her informed consent before undertaking a surgical procedure on her, wherein the Court affirmed a lower appellate court's decision to reverse a directed verdict in a medical malpractice suit after finding that an expert witness was not needed by the plaintiff to tell the jury the dangers of the surgery.
