- Abstract
The article discusses a court case wherein the Tennessee Court ruled to provide for fear-of-cancer damages and instructed for investigation on the seriousness of the fear. It cites the case filed by Thurston Hensley against CSX Transportation Inc. for negligently causing him to contact asbestosis. The Court required sufficient evidence on the genuineness and seriousness of the plaintiff's fear under the Federal Employers' Liability Act (FELA) and granted certiorari to CSX.
