The article focuses on the application by the World Trade Organization (WTO) panels and Appellate Body of key provisions relating to risk assessment and scientific evidence under the WTO Sanitary and Phytosanitary (SPS) Agreement. It talks on three emerging issues which are the role attributed to science, the adoption of the two-stage process, and the use of the principle of mutual recognition. It highlights the significance of deliberative decision-making.
