- Abstract
With the establishment of China Oil & Gas Pipeline Network Corporation (PipeChina) in 2019, the “X+1+X” system in China's oil and gas market has gradually taken shape. For a fair, just, competitive and healthy market environment, it is necessary for operators of pipeline network infrastructure that are in a position of natural monopoly to implement the fair opening of pipeline network infrastructure properly and efficiently. In this paper, an in-depth analysis is made on the connotation, status quo and problems of the fair opening of pipeline network infrastructure in China, and the paths to realize the fair opening are suggested. Specifically, the elements in the fair opening of pipeline network infrastructure, such as timing, conditions, systems, technologies and government supervision, are summarized, policy evolution is reviewed, and the implementation status of fair access, third-party access and transactions based on capacity allocation is analyzed. Five problems are pointed out, including inadequate supporting construction of a legal system, incomplete business separation, inefficient shipper access management, mediocre applicability of freight rate system, and jumbled implementation of information disclosure. Six suggestions for improvement are put forward: (1) the improvement of systems in the natural gas sector be accelerated; (2) the shipper access management be uniformly undertaken by national regulatory agencies; (3) the ways of transactions based on capacity allocation be further diversified; (4) a moderately centralized capacity trading platform be established; (5) an independent supervision system be explored to improve government supervision; and (6) a differentiated freight rate system that can better reflect the value attribute and is more compatible with the trading system based on capacity allocation be formulated and implemented. It is concluded that improving accelerating the fair opening of oil and gas pipeline infrastructure is of great significance in promoting the stability of oil and gas supply in China and safeguarding the legitimate rights and interests of operators and users.
