- Abstract
The article presents an analogy between the growth of Tennessee's state tree, the tulip poplar, and the growth of the state's common law system as of May 2013, focusing on Tennessee's negligent infliction of emotional distress (NIED) tort. A physical manifestation rule and the Tennessee Supreme Court's ruling in the case Camper v. Minor are addressed. It states that a plaintiff who witnesses the horrific death of another person does not have to be related to the person to make a NIED claim.
