- Abstract
The article focuses on the incompatibility of the McDonnell Douglas paradigm with the summary judgment jurisprudence in the case of Gossett v. Tractor Supply Inc. in Tennessee. It states that the paradigm have been adopted since 1973 for summary judgment motions. It says that the McDonnell Douglas was abandon in Tennessee for the summary judgment motions in retaliation cases and employment discrimination. It adds that the case of Gossett will result to expensive settlement for retaliation cases.
