- Abstract
The article discusses a court case which focuses on limiting patent exhaustion through restrictive licenses or conditions at the time of sale. The ability of a patent holder to control a patented article after it is offered for sale is being restricted by the doctrine of patent exhaustion. The ruling of the U.S. Supreme Court in Quanta Computer Inc. versus LG Electronics Inc. stressed that a sale authorized by the patentee can only initiate exhaustion. Interpretations of the case are also provided.
