- Authors
Basile, Thomas
- Abstract
The article focuses on the scope of the right to vote in relation to the U.S. Supreme Court case Crawford v. Marion County Election Board. It notes that despite being a fundamental right, the perception of the Constitution and the Supreme Court about the right to vote remains questionable. It adds that the reasoning of the Supreme Court for the case shows the potential for arbitrariness and activism involved its voting rights jurisprudence. It mentions that the Justices agree that such right can be invoked against laws that do not deny the franchise.
