- Abstract
The article focuses on decision of the Fifth Circuit Court of the U.S. in the case Coffin v. Blessey Marine Services Inc. It states that the plaintiff, a seaman, sought recover back overtime pay which was allegedly due under the U.S. Fair Labor Standards Act of 1938 (FLSA) and mentions that the defendant refused to pay citing the argument that barge-based tankermen are employed as seamen that are exempted from FLSA. The court ruled that the duties carried out by tankermen were nonseaman duties.
