- Abstract
The article discusses a court case wherein a former employee of Duke Energy Corp. sued Aetna Life Insurance Co. over the interpretation of Duke's long term disability plan under the Employment Retirement Income Security Act of 1974. Duke acted as the employer but Aetna was both the insurer and the plan's claims administrator. The employee filed two claims for unrelated illnesses. Aetna reduced the employee's claim benefits when it discovered the second claim. The U.S. Court of Appeals Fourth Circuit upheld Aetna's action.
