- Title
BROAD EXEMPTIONS IN ANIMAL-CRUELTY STATUTES UNCONSTITUTIONALLY DENY EQUAL PROTECTION OF THE LAW.
- Authors
Reppy Jr., William A.
- Abstract
The author discusses the constitutionality of statutory exemptions in North Carolina's first animal-cruelty statute. These exemptions, which preclude the prosecution either for misdemeanor or felony violation of the statute in nine situations, benefit several groups of people such as medical researchers, persons raising livestock, hunters and veterinarians. He also explains why this exemption is unconstitutional under the equal protection clauses of the federal and state constitutions.
