- Abstract
This article focuses on the court ruling on the case "Wertlake v. Wertlake," implying that in a case of first impression, the court decided that in New Jersey disputes concerning child support and alimony are not subject to arbitration. The husband sought to vacate an alimony order of the court. The wife, on the other hand, cross moved seeking increased child support and alimony. In response to this motion, the husband requested arbitration pursuant to a provision of the property settlement agreement incorporated into the final judgment. The court held that the portion of the final judgment providing for arbitration was invalid and unenforceable.
