- Abstract
This article focuses on the court ruling given in Gaines Contract Co. v. Carol City Utilities Inc. case. Arbitrator completely dominated and controlled by a stockholder of party-corporation was susceptible to having his judgment biased by his conduct during the course of the arbitration. The court said: "An arbitrator is required to be no less impartial than a juror sitting in the trial of a cause. If he fails in this, his usefulness as an arbitrator is then destroyed."
